150 servicemen of AFU are in custody

The main military prosecutor’s office of the Prosecutor General’s Office of Ukraine released information regarding the maintenance of military personnel in custody in criminal proceedings.

It’s noted in the material, published on the PGO website, that last time some media spread publications about ostensibly groundless detention of servicemen of the Armed Forces of Ukraine.

‘In spite of this we inform that investigators of military prosecutor’s offices and National police are carrying out pre-trial investigation, as well as prosecutors of military prosecutors supported a public prosecution in a number of criminal proceedings, where the military was elected a preventive measure – detention’, tells the message.

In particular, as of 08.14.2017 such preventive measure was applied by the court in respect of 150 persons (74 of those who served in the Donbas) who committed grave and especially serious criminal offenses, which is less than 4% of all the military personnel brought to justice this year.

Most of all people are held in custody in the proceedings, in which the trial continues – 116 soldiers. The investigation continues concerning 34 such persons.

‘In the overwhelming majority, such a preventive measure has been applied against servicemen who have committed crimes against human life and health. In particular, these are premeditated murders, including сommitted by prior conspiracy, a method dangerous to the lives of many people associated with deprivation of liberty, a useful motive, deliberate grievous bodily harm and alike’, tells the post on the website.

So, almost 60% (88) servicemen from total number are in custody for crimes against human life and health. The criminal law provides for punishment for these crimes in the form of real imprisonment for a term of 7 to 15 years.

For example, Criminal proceedings against a serviceman who, using automatic weapons AKS-74 committed a willful killing of two servicemen and injured five, and then arbitrarily left his place of service with weapons, ammunition and other military equipment, is considered by the Belovodsk District Court of the Lugansk Region.

There are also cases of causing bodily harm, including heavy from hooligan motives…

So, the investigative department of the military prosecutor’s office of the forces of the antiterrorist operation is investigating the case of the use in July 2017 by a soldier of one of the military units in the village of Peski of the Donetsk region of two RGD-5 grenades, which he threw from the hooligan motives in the direction of the servicemen. Currently, seven people are in hospital with bodily injuries of varying severity.

Also persons are detained in criminal proceedings on the fact of evasion from military service committed in the conditions of a special period, desertion – 30, illegal possession of a vehicle connected with violence, violation of road safety rules, brought to the death of the victim – 11, committing robberies- 10 and others.

The Military Prosecutor’s Office of the Odessa Garrison completed the investigation and sent to the court an indictment on the sale of 12 AKS-74 assault rifles and bayonets to them by servicemen of one of the military units in February this year in Odessa. The punishment for committing the specified crime provides for imprisonment for a term of three to seven years.
