Pechersky district court decided to return to the prosecutor an indictment according to the ex-MP’s Aleksander Efremov, Sergei Gordienko and Aleksander Stoyan, who are suspected in the falsification of the results of voting for laws from “January 16”. The appropriate decision was sounded by judge, reported the “112 Ukraine”.
“In time of preliminary court hearing was found that an indictment in criminal proceedings… doesn’t meet the requirements of Article 291 of the Criminal Procedure Code of Ukraine, because it doesn’t consist the wording of the charges in accordance with the provisions of the law. Also, this act gives only factual circumstances of the case, established by investigator in time of pre-trial investigation and it has the indication that Efremov, Gordienko and Stoyan are suspected in the committing of these crimes that they are accused”, claimed the judge.
Efremov claimed that he welcomes the decision of the court.
“We welcome the decision of the court, which decided it by law. I wonder more about other things. You heard our kind of discussion with the prosecutor. The position of the prosecutor, which can’t give guilty evidences, but demands to arrest people. They are guided by fact that somebody wrote something about us and we must prove that it is not true. They are ignoring the basic rule of the presumption of innocence of a human. We have been being in this situation for a year , when investigation with prosecutor invented case and didn’t give any of evidence. There is even no the indictment.We are very glad that they decided legally. It shows that our law enforcement system has the base to feel better”, claimed Efremov.
“The court drew the conclusion that appointed makes the trial impossible. As it was reported earlier The General Prosecutor of Ukraine ended pre-trial investigation of the case against Efremov and give it to the court.
