Hague tribunal, resolution of UN about Crimea and Klimkin’s statement.

The International Criminal Court (Hague tribunal, Netherlands) considers the situation in occupied by RF Crimea equal to international armed conflict between Ukraine and Russia. The annual report of the preliminary investigation of the ICC Prosecutor Fatou Bensouda, released on November 14, tells about it.

As it was noticed, the office of Prosecutor of tribunal has considered the application of Ukraine about investigation of this situation and made the conclusion.

‘According to coming data, the situation on the area of Crimea and Sevastopol is equal to the international conflict between Ukraine and Russia. This international warfare has begun not later than on February 26, when Russian Federation acted the personnel of their armed forces to take under control the parts of Ukraine without agreement of the Government of Ukraine’, told the report.

According to court’s opinion there is no need to establish the lawfulness of the initial intervention, which entailed the occupation. So, such international conflict will be investigated by norms of Rome Statute.

At the same time in the office of the Prosecutor of ICC has the information about the harassment of Crimean tatars on the peninsula, violate removing of 179 arrested persons on RF territory and forced mobilization for military service of Crimea inhabitants. In connection with this the prosecutor of the court decided to continue collecting of evidences of this situation next year.

During the session of Third Committee of the UN General Assembly, which is focusing on human rights, the resolution about violation of human rights in Crimea by occupation RF power was accepted. Ukraine has initiated it.

The resolution ‘Situation of human rights in the Autonomous Republic of Crimea and the city of Sevastopol (Ukraine)’ was supported by 73 UN country and 23 voted against this statement.

General Assembly has condemned by adoption of this resolution the human rights violation, discrimination, discriminatory measures and practices against residents temporarily occupied the Crimea, including the Crimean Tatars, as well as Ukrainian citizens belonging to other ethnic and religious groups, from the Russian occupying power.  General Assembly called Russian Federation to comply with all obligations under international law as an occupying Power.

According to text of the accepted document, Russia must accept all necessary measures to finish all human rights harassments to inhabitants of Crimea, stop discriminatory measures and practices, free detentions, tortures and other cruel, inhuman or degrading treatment and repeal all discriminatory legislation.

UN members also called RF to free immediately Ukrainian citizens, who were illegally detained and convicted  without accounting elementary norms of justice, also it was about those who were removed from Crimea on Russia’s territory.

Together with it the resolution marks the necessity of creation and following support of safe and comfortable conditions for the journalists and human right activists to do their work in Crimea independently and without any borders.

Except this General Assembly called Russia to open cultural and religious institutions and cancel the decision about advertisement Mejlis of the Crimean Tatar people extremist organization and banning its activities and also to repeal the decision about ban to enter Crimea to Mejlis leaders.

In its turn the President of Ukraine Petr Poroshenko claimed that adoption of the resolution of UN General Assembly about human rights in Crimea it’s the victory of equity.

The head of MIA of Ukraine Pavel Klimkin explained the meaning of adopted UN resolution about Crimea. According to his words the definition ‘temporary occupation of Ukrainian ARC and Sevastopol’ will be officially used in all UN documents before the deoccupation of Crimea after the adoption of this document about the violation of human rights. Klimkin has reported about it on his Twitter.
