Illichivsk city court found the accused in the case of May 2, 2014 (in the part of events on Grecheskaya square) innocent. ‘Interfax-Ukraine’ reports that court found the evidence of accusation of participation and organization of the accused in mass riots, which resulted in grave consequences (death and trauma of people), was untenable.
Moreover, the court drew the conclusion that the investigation into the case was carried out not qualitatively, and pointed to a number of shortcomings and gaps in the conducted investigative actions. For example, only one police officer was interrogated in time of the investigation from among those who attended Grecheskaya Square.
The court also considered biased the testimony of the sole prosecution witness Alexander Pozmichenko, who claimed that the defendants were involved in the crimes allegedly committed against him, and therefore the court decided not to take them into account in the sentencing.
The testimony of other witnesses, according to the court, doesn’t confirm the participation of the accused in mass riots, especially in their organization.
Otherwise, the court excluded from the list of evidence few points in connection that they were obtained in violation of the norms of the Code of Criminal Procedure.
Also the court wasn’t satisfied by photo- and video materials which were provided by prosecution. According to court’s opinion, prosecutor can’t confirm by any way that accused were depicted on the photo and video.
Unproved unsubstantiated, the court acknowledged the allegations of the prosecution that officials and first persons of the state during the presidency of Viktor Yanukovich were involved in organizing the events of May 2, 2014 in Odessa. At the same time court considers that investigation unreasonably missed the actions of the authorities that operated after Maidan, including Andrei Parubiy and the former head of the Odessa Regional State Administration, Vladimir Nemirovsky.
We would remind that during mass riots in Odessa on May 2, 2014 48 people died and more than 200 were wounded. The biggest part died in time of fire in the House of Trades-Union.
Law enforcements of Ukraine had been beginning a dozen of criminal proceedings, according to different facts. The most resonant of them is the case of the events on Grecheskaya Square, where the first clashes took place between pro-Russian and pro-Ukrainian activists.
